Nelson Rose, a gambling law expert at Whittier Law School in California, said the Beshear administration is attempting to use an old statute that is still on the books in many states.<\/p>\n<p>The Kentucky law says that in instances of illegal gambling the winners have no right to collect. Losers who pay up can sue to recover triple the amount of their loss under the law.<\/p>\n<p>The statute goes further, stating that if the loser doesn&#8217;t sue within six months \u201cany other person may sue the winner. \u2026\u201d<\/p><\/blockquote>\n<p>This is an outrageous assault on personal freedom.\u00a0 It&#8217;s not the first time Kentucky as tried such a thing.\u00a0 In 2008 the state filed suit to protect their own gambling racket:<\/p>\n<blockquote><p>In its previous legal initiative, the Beshear administration filed suit in 2008 in an effort to seize and shut down 141 online gambling <a href=\"http:\/\/www.courier-journal.com\/article\/20100406\/NEWS01\/4070364\/1008\/Kentucky%20sues%20to%20reclaim%20gamblers%20%20losses%20online#\" target=\"_blank\">domain names<\/a> \u2014 Web sites \u2014 in part because of concern that they were draining revenue from the state&#8217;s horseracing industry.<\/p><\/blockquote>\n<p>Is this really how the people of Kentucky want their government to spend its time and resources?\u00a0 I think the voters need to send these meddling nannies packing.<\/p>\n<p>Hat-tip: <a href=\"http:\/\/overlawyered.com\/2010\/04\/kentucky-sues-to-reclaim-gamblers-losses-online\/\">Overlawyered<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The state of Kentucky is suing to recover the losses of Kentucky citizens who played online poker: I.
